3rd District Appellate Court Rules for Healy Scanlon Law Firm client in Ford Explorer Rollover Fatality

The 3rd District Appellate Court has ordered a new trial in favor of two Healy Scanlon Law Firm clients injured in a Ford Explorer Rollover.

Kerri Francois was seriously injured and Lisa Rooney died when the 1994 Ford Explorer Rollover Rooney was driving rolled over on I-55 near Morris, Illinois. Healy Scanlon Law Firm filed a products liability suit against Ford Motor Company on behalf of Rooney’s family and Francois.

Following a three week trial in Grundy County, the jury found in favor of Ford. Healy Scanlon Law Firm promptly appealed the matter to the 3rd District Appellate Court who ordered a new trial. The Court found that the trial judge committed error in letting a Ford expert testify at trial even though he had never been disclosed by Ford as a witness prior to trial. The Appellate Court subsequently denied Ford’s petition for rehearing.
